These general terms and conditions of sale govern all relations between the company Veja Fair Trade SARL, a company with a capital of €100,000, whose registered office is located at 146 rue du Faubourg Poissonnière 75010 Paris, registered with the Paris Trade and Companies Register under No. B478328107, VAT No. FR89478328107, hereinafter referred to as "Veja", and the customers of the website www.centrecommercial.cc.

Article 1: Special Terms of Sale

The customer acknowledges having read, at the time of placing the order, the special terms of sale displayed on the screen (name, price, quantity, color, product specifications, cost of services) and expressly accepts them without reservation.

 

Article 2: Order Validity 

The offer on the website www.centrecommercial.cc is exclusively for individuals with an address in mainland France, Europe, and internationally in the list of proposed countries.

 

Article 3: Order Registration and Confirmation

Centre Commercial confirms receipt of an order by an email titled "Order Confirmation".

However, the sale will only be concluded upon confirmation of the order by Centre Commercial, in an email titled "Order Shipment", which will be sent to the customer no later than three working days after the order is registered.

Centre Commercial reserves the right not to confirm an order, depending on product availability, a foreseeable problem concerning the delivery to be made, a dispute relating to a previous order, or incomplete or abnormal payment.

In this case, Centre Commercial will inform the customer no later than 5 working days after the order is registered and will promptly refund the customer or request additional information regarding the payment.

If only one of the products in an order is unavailable, the rest of the available order will be shipped.

 

Article 4: Prices

The prices indicated are in euros. The billing currency of the order is in euros.

Centre Commercial reserves the right to modify its prices at any time but undertakes to apply the rates in force that were indicated at the time of the order, subject to their availability on that date.

 

Article 5: Payment Methods and Security

Payment can be made by credit card: Visa, Mastercard, American Express, on a secure banking server.

Credit card details are encrypted using the SSL (Secure Socket Layer) protocol and never transit in clear text over the network.

Payment is made directly to our banking institution. Centre Commercial does not have access to these details and does not store them on its servers.

Payments via Paypal and Apple Pay are also accepted.

 

Article 6: Retention of Ownership

The products remain the property of Centre Commercial until full payment of the order is received.

 

Article 7: Delivery Methods and Times

A maximum period of 3 working days after the order is registered may be necessary to ship the order.

The ordered product is shipped via the postal circuit, via Colissimo tracked to the delivery address indicated by the customer.

In France:

Delivery costs are 8 euros. For purchases over €50, shipping is free.

In Europe:

Delivery costs are 15 euros. For purchases over €100, shipping is free.

Internationally:

Delivery costs are 25 euros. For purchases over €150, shipping is free.

International orders, outside the European Union, are sent without VAT. Centre Commercial will not be responsible for import duties, customs, and local sales taxes levied by the destination country. Import duties or tax fees will be billed directly to you by the delivery service.

For any order placed before 11:30 am, the order will be prepared the same day. After 11:30 am, the order will be prepared the next day.

For any request for in-store pickup, a notification email of the order's availability will be sent to the customer so that the pickup can then be made at the following address:

For any order containing Outlet products, please allow an additional 7 days to the delivery times indicated below.

Article 8: Right of Withdrawal

When purchasing items, you have a legal right of withdrawal.

Please note that for any return of merchandise, you can use the return label attached to your order or that you can print from your customer account. If you do not have a printer, have difficulty downloading the return label, or need a new label, you can contact our customer service, whose contact details are provided below. To avoid unnecessary costs, please do not return the merchandise without the return label (excluding sales and clearance).

 

Article 8.1: Information on the Right of Withdrawal

You have the right to withdraw from this contract without giving any reason within fourteen (14) days. The withdrawal period expires fourteen (14) days after the day you, or a third party other than the carrier and indicated by you, take physical possession of the goods or the last good in case of partial delivery.

To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post, fax, or email). You may use the withdrawal form below, but it is not mandatory.

You can also complete and submit the withdrawal form or any other clear statement of withdrawal electronically through our contact form on our website.

If you use your right of withdrawal, we will send you an acknowledgment of receipt of your withdrawal without delay (e.g., by email).

To meet the withdrawal deadline:

 

(1) You must send us your withdrawal statement before the withdrawal period expires;

(2) The products must not have been used, opened, or damaged;

(3) The products must be returned intact and unused in their original packaging. If applicable, the packaging must retain the original seal. 

 

Article 8.2: Exception to the Right of Withdrawal

In accordance with Article L. 221-28 paragraph 5 of the Consumer Code, the legal right of withdrawal is excluded for sealed items that have been opened after delivery and cannot be returned for health or hygiene reasons.

 

Article 8.3: Effects of Withdrawal

In the event of a valid withdrawal, we will refund all payments received from you, including delivery costs (except for additional costs) without delay and no later than fourteen (14) days from the day we are informed of your withdrawal statement. We will proceed with the refund using the same payment method you used, unless we expressly agree on a different payment method. The refund is free of charge for you. We reserve the right to defer the refund until we have received the goods or until you have provided proof of shipment of the goods, whichever is the earliest.

You must return or hand over the merchandise to us without delay and, in any case, no later than fourteen (14) days from the day you communicated your withdrawal statement to us.

This deadline is met if you send the merchandise before the expiration of the deadline. We cover the return costs if you use the return label provided for a return within French territory. In all other cases, the return costs are your responsibility.

You must bear the loss of value of the returned merchandise if this loss of value is due to handling other than what is necessary to establish the nature, characteristics, and proper functioning of the merchandise.

Article 9: Provisions of the "Informatique et Libertés" Law

Centre Commercial has declared the file containing personal data relating to customers of the website www.centrecommercial.cc to the National Commission for Information Technology and Liberties (declaration No. 1235194 in accordance with the provisions of the Data Protection Act of January 6, 1978).

Under this law, the customer has the right to access, rectify, or oppose the personal data collected concerning them. These rights can be exercised online in the "my account" section or by email sent to customers@centrecommercial.cc

 

Article 10: Intellectual Property 

The customer is prohibited from copying or downloading all or part of the content of the website www.centrecommercial.cc without prior and express authorization from Centre Commercial, which remains the sole owner of all intellectual property rights related thereto.

 

Article 11: Applicable Law

These general terms and conditions of sale are subject to French law.

 

Article 12: Legal Warranties 

 The products sold on Centre Commercial benefit from the legal warranty of conformity (as defined in Articles L217-3 and following of the Consumer Code) and the warranty against hidden defects (as defined in Articles 1641 and following of the Civil Code).

Excluded from the warranty are damages or defects that you knew or could not ignore at the time of purchase, those originating from materials you provided yourself, as well as those resulting from improper use of the product.

Implementation of Legal Warranties

In accordance with Article D. 211-2 of the Consumer Code:

"The consumer has a period of two years from the delivery of the goods to obtain the implementation of the legal warranty of conformity in the event of the appearance of a defect of conformity. During this period, the consumer is only required to establish the existence of the defect of conformity and not the date of its appearance.

When the sales contract of the goods provides for the supply of digital content or a digital service continuously for a period exceeding two years, the legal warranty applies to this digital content or digital service throughout the supply period provided. During this period, the consumer is only required to establish the existence of the defect of conformity affecting the digital content or digital service and not the date of its appearance.

The legal warranty of conformity entails the obligation for the professional, if necessary, to provide all necessary updates to maintain the conformity of the goods.

The legal warranty of conformity gives the consumer the right to repair or replace the goods within thirty days following their request, free of charge and without major inconvenience to them.

If the goods are repaired under the legal warranty of conformity, the consumer benefits from a six-month extension of the initial warranty.

If the consumer requests the repair of the goods, but the seller imposes replacement, the legal warranty of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer can obtain a price reduction by keeping the goods or terminate the contract by getting a full refund against the return of the goods, if:

 

1° The professional refuses to repair or replace the goods;

 

2° The repair or replacement of the goods occurs after a period of thirty days;

 

3° The repair or replacement of the goods causes a major inconvenience to the consumer, especially when the consumer permanently bears the costs of returning or removing the non-conforming goods, or if they bear the costs of installing the repaired or replacement goods;

 

4° The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

 

The consumer also has the right to a price reduction or contract termination when the defect of conformity is so severe that it justifies an immediate price reduction or contract termination. The consumer is then not required to request the repair or replacement of the goods beforehand.

The consumer is not entitled to terminate the sale if the defect of conformity is minor.

Any immobilization period of the goods for repair or replacement suspends the warranty period that remained until the delivery of the restored goods.

The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the Consumer Code.

The seller who obstructs in bad faith the implementation of the legal warranty of conformity incurs a civil fine of up to 300,000 euros, which can be increased to 10% of the average annual turnover (Article L. 241-5 of the Consumer Code).

The consumer also benefits from the legal warranty against hidden defects under Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This warranty entitles the consumer to a price reduction if the goods are kept or a full refund against the return of the goods."

You can also attach photos and/or videos, and our dedicated team will review your request and respond as soon as possible.

These provisions do not exclude the right of withdrawal defined in Article 8 of these terms.

Article 13: Amicable Settlement of Disputes

Under Article L. 612-1 of the Consumer Code, "Any consumer has the right to resort free of charge to a consumer mediator for the amicable resolution of the dispute that opposes them to a professional." This applies to contractual disputes concerning the execution of a sales contract or the provision of services, opposing a consumer to a professional.

In case of difficulties, we invite you to contact our after-sales service first (see point 11). If your problem is not resolved, you can use the services of a mediator within one (1) year from the receipt of your request by the after-sales service, for the extrajudicial resolution of the dispute.
